Student Loan debt is one of the fastest growing debt problems in the United States today.  The average student loan debt of graduating seniors is now more than $25,000.  The amount of student loans taken out last year crossed the $100 billion mark for the first time and total loans outstanding will exceed $1 trillion for the first time this year.  In fact, according to the Federal Reserve Bank of New York, the U.S. Department of Education and private sources, Americans now owe more on student loans than on credit cards!

Few people are aware of their options.   Information can be difficult to find and frequently those who are collecting on student loan debt don’t properly explain a borrower’s options.  Sadly, even if the collector does offer the borrower the right repayment options, frequently, the collectors do not administer the repayment options correctly and deny the borrower their rights.

In order to understand and properly explain your options we need the following information:

  1. The status and holder (who you make payments to), including and servicers or debt collectors involved, of all of your loans.

  2. Copies of any and all collection letters and other correspondence you have received (from all parties involved in your student loans.

  3. A history of your student loans starting from the time you incurred them (or as far back as you can provide).

  4.  Your desired outcome.

When we review your case we are looking for the following: 

  1. Can We Help You - We are first trying to see if there is something we can do for you.  This will depend on many factors including whether your loans are private or government, the current state of delinquency, your income, and your ability to pay (in some cases). 
  2. Collector/Servicer Behavior - We want to see if the servicing and collection of your student loans have been handled correctly.   Often, collectors misinform student loan borrowers regarding their rights regarding loan rehabilitation, income based repayments, and other repayment options.

  3. Violations of The Law - If we find a violation of the law, there may be damages that could subject the servicer or even the school to legal action.  We are also looking to see if the collector is violating the rights of other student loan borrowers, just like you.

Generally it takes 3 business days for us to complete your case review.  If we determine we may be able to assist you, we will schedule a consultation over the telephone or at one of our offices. The consultation takes 1-2 hours depending on the complexity of your case. 

During the consultation we will:

  1. Review your circumstances and the collection conduct.  
  2. Educate you on what can and cannot happen.
  3. Review all your options based on your specific circumstance.
  4. Create an action plan to deal with your loan(s) and the debt collector which may include legal action against the collector.

The cost of the consultation is $300 and due at the time of consultation.  We accept personal checks, cash, money orders and all major credit cards.  We offer appointments Monday through Friday during our regular business hours.  For your convenience we also offer weekend and evening appointments.

Please note: even though you submit any or all of this information to us, we do not represent you nor are we taking any action on your behalf.  The only time we are representing you is when a Legal Services Agreement is executed between both you and the Law Offices of Craig Zimmerman.
